How to evict a squatter in foreclosure?

I have one month left to beat foreclosure, and I can pull it off - however, the last 5 months that I've been working out of town, my now ex-girlfriend has been living there with another man, and not paid a single dime of a then-trusting oral agreement.

This also has the condo association board upset, as we have various strangers in and out of the building. I'm the only one on the title, but she has mail in her name, as well as utilities.

How, on earth, can I make her (and him) leave, quickly and legally? I don't want to settle my foreclosure, then run into some weird squatter rule as the police have already been there looking for him at my address...

  1. sorry to hear that Caleb, but from my experience this happened similarly to a friend of mine i believe the first this is to make a police report and inform the condo assoc. that you are working on the problem so that they can help you out as much as they can, specially you are out of town. good luck. hope this helps. and if you can afford a layers advice go for it it is always a phone cal away .


  2. If you don't plan on taking the home back, then leave her alone.

    By the time you evict her, if it's been 5 months, they will sell the property before that and the Sheriff will remove her.

You need to evict her like any other tenant, send her a 3 day notice  to quit the property "her name and all others" (specify all names if possible) and file this eviction at the sheriff's office. This is a standard form used to evict tenants. I don't know what happens to your stuff when they evict her, because they usually remove all the belongings and pile them up on the street, so you had better be on hand that day. You really need a lawyers advise here and I know you can't afford that. I'm not a lawyer but that's how an eviction works.
