Question:

How to fight and beat a traffic ticket...?

I recently bought a new car from a private party with expired tags by only 6 days (the title isn't even in my name yet). On my way to get the car fixed (bad cat) so I could pass emissions to get it registered and get the title placed under my name....a cop pulled me over and cited me for the expired tags. How was I supposed to get my car to the emissions place if I couldn't even drive it right after I bought it? I was trying my best to do what I needed to do so I could get it registered! I had insurance and no previous tickets...why would a cop do this?? I was very nice and told him my situtation. How can I fight this ticket in court and win? There is too many websites that want me to buy this information...anyone have any tips?

  1. You forgot to mention what state you are in, but chances are that the expired tag charge will be dropped if you get the car registered before the court date.

  2. Chances are low (to put it mildly) that you stand a chance in court - you did drive without valid tags and that is illegal and therefore the cop was correct to cite you (even though it wasn't nice). With regard to your claim "how could I get it fixed without driving to the repair shop" the answer is simple, have it towed. When you bought the car you knew that the tags were expired. It's not nice, the cop should have let you off with a warning but the law is the law ,I think.

  3. I don't think you can win.  You admit to breaking the law...driving with expired tags.

To avoid breaking the law, you should have taken care if it before you bought the car.  Secondly, you could have had the car towed since it was not legal to drive it.

  4. Registering after the fact is no defense.  You drove with expired tags, plain and simple.  Pay the ticket.
