We've been married four years but have not lived together for the last two years. We have no joint debt, property or money. He has openly admitted to cheated on me, he was physically and emotionally abusive to me while I was pregnant. Our son is 2. He does not want anything to do with me or the child. He actually wrote out all of the cruel things he's done to me and how he planned to hurt me and my son. (He gave me stack of letters he signed that state all of those things). He is really a piece of work and I need him removed from our lives. We were married in North Carolina, lived only in that state together and when he kicked me out while I was pregnant, I came to NY and have been here since.

Do I need a lawyer? Can I file divorce on my own at city hall? How do I go about getting his parental rights removed?

  1. chan, I got divorced last spring, so I know a little bit about the divorce process. For the most part my attorney helped me through the tough times. The rules are probably different in New York than West Virginia (where I used to live) so I don't want to give you bad advice. Try visiting a New York divorce attorney for help. http://www.legaldivorcelawyers.com/New-Y...

    Hope everything works out

  2. well, first you have to get a lawyer, and he'll step by step tell you what to do.

P.S dont be mad at me for this, but you should not try to get his parental rights removed. he may be bad, but he is still a father and your child will need him. An easy way to terminate his rights would be to lie because women can do that in court, but i suggest that you dont for the sake of morality
