How to get Speeding Ticket Points reduced?

I received a speeding ticket this morning on my way to work. VASCAR clocked me going 62.2 in a 40mph zone. I will fully admit that I was speeding but...there is just no way I was going that fast. I was going up hill in the passing lane. At the top of the hill...the road merges into one lane. I was in the middle of passing a big rig and I didn't want to get caught still passing him in the "no passing" zone. So I sped up to get ahead of him before the no passing zone. I know that the cops hide when they VASCAR but I have NO CLUE where he could have been sitting to clock me while I was on the other side of this truck. I know that the officer that pulled me over wasn't the one clocking because he was already at the top of the hill when I got there. I am not worried about paying the $162 fine, but...i just really don't want the 4pts on my record. This is my first ticket ever in 12 years of driving. My driving record has been excellent. Any argument suggestions for court?

  1. A lot of times, police will set up a speed trap (one officer clocking, the other pulling over the cars).  The one clocking doesn't even have to be in a car.  I saw an episode of "Speeders" on TruTV last night, and the one doing the clocking was in camoflage hidden along the tree line using a laser speed gun.  Unfortunately, you are probably screwed unless you can prove that your speedometer was off. This can be done by getting your speedo calibrated (a shop should be in your local yellow pages).  It might not get you out of the ticket, but it could reduce it if it is off.  Good luck.


  2. First ticket, then you should have no problem asking the judge if you can take a defensive driving course and that will take care of your problem.

You can't admit to speeding, you were either speeding or not...As far as contesting Vascar or Aircraft ticket where they time you between marks in the pavement, I got the points removed on a ticket on I-4 in Orlando by my attorney (personal friend) requested to review the log, upon doing this he noticed that the vehicle stopped right in front of me had a difference in logged time of 2 /100ths of a second and that the human was not able to react in that time frame, so the log had to be estimated not precision accurate which is required. Therefore the judge agreed that I likely wasn't going the stated speed however that he was sure I was still speeding, so he reduced the points to 0 and ordered a driver improvement course which did not count toward my elective choices to do so and get the points reduced...

    In Florida your allowed to do this 5 times in a lifetime... as for where he observed you, I've seen them observe from a distance both uphill and down hill using binoculars, Vascar is an in cruiser device that calculates MPH by entering the time you traveled between measured distances...

    You can contest this, but it would take an attorney with experience in vascar to be able to go head to head with a trained Police officer...

    Depending on where you live, that wasn't stated, you may have the driver improvement course option... I know you can schedule a court hearing and plead not guilty at your arraignment, then hope that the cop doesn't show up for the actual trial and you get it dismissed...If he shows up maybe you can ask the judge for a reduction in point penalty for having a clean record up to now.

    I'm sure some leniency would likely be offered.
