My younger brother is living in NY having green Card through DV 2004. Last November, 2006 he came Bangladesh to visit us. He also got marriage in February, 2007 according to our will. My brother's wife has passed Diploma in Agriculture with 1st class from Bangladesh Agriculture Institute. My brother went to NY in March, 2007. He informs us to bring his wife in NY at least after 1 and 1/2 years. Because he needs to first get his original passport & then apply for his wife. My asking is that if she wants to face US embassy in Bangladesh for visa to get admission for higher education in NY, will she avail any extra opportunity for getting visa. Please inform me how we help my brother's wife to live in NY within 6 month. Your cooperation will be highly appreciated.

  1. It 's now taking  us ( US citizens ) up to 11 months to get a passport , (so we can get back from Canada   * arrghhhh!*)   , so it's probably not going to happen for her in 6 months . Sorry for the inconvenience . The current crop of geniuses running the show in DC, seem to specialize in wrecking things .

  2. She's married to a Green Card holder.  Any attempt to get a work or student visa is going to be viewed as an attempt to get around the immigrantion quotas and will be denied.

He should petition for her now.  The wait is about 5 years for a Green Card holder to bring a wife to the United States.  The sooner he files for her the better.

  3. Your sister-in-law is welcome to apply for a student visa (F-1).  If she is qualified, she may be considered for a visa.  However, it is more likely that she will be viewed as using a non-immigrant visa as a way to circumvent the long delays associated with a Lawful Permanent Resident (LPR) petitioning for his wife to join him in the US.

More and more effort and technology are being expended to put a stop to abuses of US visas by people who have no intention of honoring the return requirements.  Now, more than ever before, people who attempt to manipulate the visa system are being discovered and held accountable, with sanctions which could include a lifetime ban from the US.

  4. Yes, true, it will be very difficult for her to enter on a student visa.  This visa requires that she establish an intention to return to her home country after her studies.  Being married to a permanent resident will create significant difficulties in establishing that.

Your brother can petition immediately for his wife, but the wait time for this category is several years.

6 months is much too optimistic.  She can begin looking for a job offer in the U.S. and apply for an H-1B worker visa when the application period opens Apr 1, 2008.  She will not be able to enter until Oct 1, 2008.  She can then work here while waiting to immigrate under her husband's permanent petition.
