  1. The insurance company is playing a cat and mouse game with you.  Apparently the adjuster does not feel comfortable making the first offer.  I typically let the claimant make the first offer to see how reasonable their claim was going to be.  Nothing says the insurance adjuster has to make you an offer.  I would send him a letter and "CC" his manager advising them you are ready to settle your claim and would like to have them open up negotiations.  In most negotiations the adjuster will make two attempts to settle your claim and the third offer will be his last.  If he makes the first offer then in essense he is going to have to make four offers (4th to counter your third demand).  The adjuster will be making offers within a range of authority.  By him making four offers, there will likely be less movement within the range.  By that I mean if his range is 3-6K dollars then he has to spread the 3K over four offers making each one worth about $750 vs. $1000.  Good luck

  2. You sue the person who caused your damages.

Not enough information here, it really depends on WHY they don't want to give an offer.    You should probably discuss this with your agent.

  3. Have no idea what you're talking about.
