How to get brothers family to America.

My husband has become a citizen and is going to bring his brother over to help with money. But the brother won't come unless he knows his wife and kids can come later. Can my brother-in-law bring his wife and kids with him or does he have to live in America awhile first. My husband would be the one sponsering him so I am not sure how to get his wife because she is not a relative by blood. PLEASE, If anyone has experience answer. We need his brother over here because we have no family and they want to start a business. We need to make sure he can get his wife. Thank You.

    Unfortunately, your brother's in law only chance of coming sooner than the 11 yrs. is to apply for a tourist visa and if and once he gets it, he may have a shot of changing it to a family category. He will lawfully stay in America, but without his wife and children. They will have to stay behind as a guarantee that he has something/someone to go back to - to his own country.

    Another option, your husband could start the business on his own and then try to bring his brother on a working visa. This way the brother and his wife could have a chance of coming together and be here legally. And during their stay, your husband could sponsor his brother for the green card, and the brother's wife and their children would get it as well. This may be the best solution here.

  2. When your husband's brother applies for his visa at the US embassy in his country of origin, his wife and children may apply for their own visa at the same time.

    Keep in mind that petitions to bring a sibling of a US citizen to the US currently takes at least 11 years. What that means is that people who applied in 1997 are currently being allowed to apply for their immigrant visas.

    Your husband can apply for a green card for his brother... his wife and children under 18 can also be included on the application. However, the wait time for these kind of application is about 8 years.

    Or your husband can start the business, then sponsor his brother on an employment visa H-1. His wife and minor children can also be included on the visa. This will cost more and the H-1 can only be used for six years. After that you will have to apply for something else.

  4. You and your husband could always try the unique approach to keeping the entire family together.....You two could immigrate to the country your brother and the rest of your family lives in....

    Only two persons would have to move - the rest of the family would already be used to the local culture, laws, and even would most likely speak the local language.....

    Your brother could sponsor you and your husband to your new country....your brother wouldn't have to be separated from his family to meet up w/ you and your husband....

    When you got there - I bet he could even put up the two of you til you learned the language, got a job and became legal residents....
