How to get custody of my boyfrineds son

my boyfriend have a son by another girl.. he wants custody because she dont care of the child.. everytime we come and get him. he's always n the floor and nobody is really paying attention to him. and all the time that we had him his ears be full of wax, his nails and toenails be dirty and everytime that we wash him or give him a bath, he cries.. and we think that he is crying because he is not used being bathed. and when we wash him.. the water in the tub is dirty. its really dirty.. one day we got him and we just wiped his legs with wipes.. the wipes is so dirty... i dont know how she takes care of him(the other woman) its just ashame how she's neglecting her son. she just wanted to have a baby so my boyfriend could be in her life.. its just crazy how she takes her anger out her son by being an unfit mother.

    if they remove child from hom your boyfriend will have the first option to have custody as long as there is no criminal record of abuse or drugs.

I see a lot of people telling you to call child protective services on her.  The harsh reality of it is, more than half the time they will close the case saying not enough evidence.  The reason I say that is while we were trying to gain custody of my husband's daughter, CPS was constantly involved and though the school said she stunk really badly, was poorly dressed and dirty, dressed improperly for the weather and wearing shoes much too big for her, infested with head lice and covered in bruises, CPS said there was "no evidence" of child abuse or neglect.  It is difficult to get custody from a mother, no matter how crappy she is, and from what you have written in here, she is obviously not a good parent.  I feel sorry for the little boy, he needs love and nourishment from you and his father who really seem to care about him.  You will have to go to court.  You will have to take pictures of the child dirty and filthy, try your best to prove to the judge that she isn't fit and isn't taking care of him.  It may take a long time, but ultimately it will be worth it if you can prove to the judge that you are fit.  Also, it may help to ask the judge if a custody evaluation could be done to determine who is the better fit parent.  These things helped us gain custody of my step daughter and she is living with us all the time now.  Best wishes to you.  I would list some legal references but I'm not sure what state you live in.  

  5. Your boyfriend, can call 'child protective services...make police reports and file a motion in family court for full custody of the child.

  7. The baby is so lucky to have you! This is such a sad situation. I am sure that you guys could get custody somehow. Ask the mother if you can take him with you for a few days-You never know, she may end up not coming to get him! Then it would be a lot easier to get custody of him! Good Luck!
