How to get my belongins from a car who has been repossessed?

This really urgent!

I get separated from my husband for domestic violence, we had two cars but both of them was only under my husband name, but the insurance was under my name for the car that I've been using. I just found out that the bank repossessed the car that I've been driving, I thought that my car has been stolen that day, I was about to bring my baby to the child care early in the morning before to get to work and the car was gone...

I had no idea that he stop to pay the loan for the car that I've been driving, nobody never contact me to tell me about this. They just came and took the car in front of my property in the middle of the night.

My question is How to get my belongins from this car, most important I really need the car seat, stroller etc.

and I don't know what to do to have those items back. I know that my strange husband will never help me to solve this matter, where should I turn for help?

  1. If you have the same last name you most likely will be able to get into it.If not you probably wont without hubbys permission...they will let you into it to get stuff out though.

    Happened to daughters friend.her ex bf bought a car off some guy he was paying him the guy wasnt making the payments and they came and got it and wouldnt let him get the stuff out til the guy gave permission..

I hate to say this, but it is going to depend on the laws in your state, I own a repossession company in Virginia and BY LAW we can only turn possessions or vehicles over to the Registered owner of the vehicle .. which in your case is your husband. Without your name on the title of the vehicle you would not be able to redeem in the state of Virginia. Insurance has no bearing on redemption of a repossessed vehicle or its contents.  Also, be warned there will possible be charges on your personal belongings for storage which accumulates daily and personals are only returned after storage costs are paid. Some states, as Virginia, by law the repossessor has to keep personal belongings for only 30 days before disposing of them.     Any good repossession agent would have knocked on your door to ask if you wanted to remove your belonging then, especially if there was a car seat in the unit, at least this is the way I run my business.

  3. First off.....you need to get an Lawyer. This is very wrong of him because he is taking away from the Baby. He can't do that by any means without getting into trouble with the law. I would call the police for this as an added act to you and the baby, as this was deliberate. So first call the police, and see if they will take a report. Then call anyone that can help you get a Lawyer. Then call the Car Loan Company...and get what information you need to find the car, and get the personal belongings out of the car. THEY CAN"T KEEP your personal belongings.....I went thru this with my kid....He couldn't pay for the car....and I refused to keep helping him, so his 2000 New Focus....went bye bye....I did take him to get his personal belongings. First we had to go to the REPO Place...with identification and proof of ownership of the vehicle, then they give us the information and address of the place to go. With a paper from them we were able to have just a few minutes to clean out the car, they checked the car to make sure we didn't tear it up too....We got his stuff and left.   Your husband is a jerk and you know it now. But you need the law on your side, and protection. Make it as hard for him as you can. And be very careful, watch your back.

  4. Your ex is an a*****e. Take your insurance policy to the repossession lot and show them that your name is on the policy (the car is listed on it)  and explain the situation, by LAW they can not keep your personal belongings. Take your baby too for sympathy.

  5. Call whoever repoed the car and ask them when a good time to come get your stuff is.. they are used to it and won't make a big deal out of it..

  6. its the bank that re-posses cars (etc). call the bank where u got the loan from and she should tell you where it was towed to. you might be able to contact the impound and tell them that you have a baby and there are things you need in the car for the baby. see if you can get the bank to get the loan money off of your husband and get the loan put in your name. i'm not sure how well that'll work since its in his name, but give it a shot. most of the time people who get re-po'd dont get their cars back. sorry.  :(   good luck.
