how could he knows the internet provider of someone by the address , someone committing crime of cyberstalking ? a person is accomplice if she s being stalked and not report it ?

  1. Your main problem: the person lives abroad; that leaves only option against the host web site if located in the US; to wit, that would be different complaint then a good old TRO issued from the local court house

    While it maybe a federal crime, does not change the facts that they live abroad and the cyberstalking is happing on a open public forum, not sure if you will get a DA to bite on this one

  3. To my knowledge there is no way to get a restraining order for such a claim.  I am not aware of any statue that identifies a crime such as "cyberstalking."

    As far as your detail, sorry, but I can't make heads or tails of what you are trying to say.  Except, "a person is accomplice if she s being stalked and not report it ?"  No, Jeeves, a victim cannot be an accomplice in a crime against themselves.  That is legally ridiculous.

  4. you asked this question several times the last few days minus the restraining order part...........no she is not an accomplice.

    It's been explained to you that the "cyber stalking" you are referring to is strictly on a forum "chatting" site and it's easy, ignore the person, report them to the site, or simply go to another forum.  The internet provider has nothing to do with it.

    From the last question you asked that I answered in you seem to know for a fact that this is a federal crime and you can prove who is saying these things etc....if that is the case why don't you get off of the computer, pick up the phone and call your local police department and try to file a report.  Ask them what you need to do in order to get a restraining order.  It also seems you only want them off the forum you visit and feel it is your right to be there and they need to be forced to move...............

    It seems to me you have asked and brought up the same scenario many different times in the last week.  You are obviously not getting the answers you want here if you keep repeating them.  If you want DEFINITE answers call your local police department and file a report if this "cyber stalking" is such a problem for you.

    If that is all he wants I hate to break it to you but that is NOT stalking and what you have described is NOT a federal crime its a simple annoyance and if it's been reported but nothing done about it then there is a reason nothing is being done about it....it hasn't become a crime.  ALL he can do is report them to the forum and it's up to them if they chose to block them.  If they choose not to block them then his only course of action is the find a new forum.

    no I doubt you'll be able to file a police report online, call them or go to your local police department.
