  1. an individual does not recover tax from income tax department, it is the department which recovers unpaid taxes from individuals and corporates.

    If the tax has been paid in excess you apply from refund in the income tax return which u will be filing now.


  2. It seems TDS has been deducted from you, whereas your actual tax liability is less. In this case you will to file for a refund. Now the first question is when was the TDS deducted and have you filed related to that period. If it is for the current period then no problem you can claim refund when you file your return, however if it is related to previous periods, it may not be that simple as you will have to file belated/revised return depending on your case facts.
