How to remove tenants from my home once lease is up?

Our lease with our tenants is up and we will not be allowing them to renew (year lease) because we are selling. All of the forms I have researched are for evicting tenants for non-payment of rent or whatnot, but that is not the case. I need something to give them in writing just for paperworks sake that I will be taking back the home and they have 30 days to vacate. Help?

  1. How much notice does your state require to terminate a year lease?

    You must give them proper written notice that their lease is terminated on XX day. If they fail to move then you need to evict them through the courts.

    Different states have different terms for their failure to vacate. Generally, it is considered holding over without permission.

    In my state, the eviction would be filed as either "Lapse of time" or "Where one originally had the right or privilege/is now terminated".


  2. Just type up a notice that contains their names, the property address and the date the lease ends.  Tell them they will need to vacate by that date as you will not be renewing their lease.

    If you want to add some honey, mention that if they vacate on time and leave the property in good condition you will be happy to write them a letter of reference (assuming they have paid on time and otherwise been satisfactory tenants).

    Mail the letter First Class and get a Certificate of Mailing from the P.O.


  3. You need to send them notice in writing 30 days (at the start of the month) that you will not be renewing their lease. It is best not to state why -- don't get into that, it's none of their business. Just state this is your notice to vacate, we will not be renewing your lease. Send one copy certified mail, return receipt requested, and drop another copy off at the property.

  5. You don't need an official form in fact as far as I know there isn't one unless you end up in court. Just type a letter stating that you will not be renewing their lease.You do not have to give a reason. Give notice on the first of the month. If they don't leave then you file with a district justice.

  6. Go to www.hud.gov and pull up the section on renting, where you’ll get laws by state.

    In my state, you simply have to send a letter via registered mail 30 days in advance of when you want them out.
