How to solve a legal problem?

My parents own a property in Hyderabad. But someone else is giving trouble and the case is in the court. The others are trying to claim our property by false documents. But they can even manage the judge. so, my parents are afraid to go to the court because the judge most of them are corrupt can give a wrong judgment or judgment in their favor even if we prove that my parents own it with legal documents.

Your parents need to get a lawyer that deals with such cases.

As the case is in court, logically, the concerned parties do need to take part in the proceedings so that their view point could be considered at the time of decesion.

You get what you strongly belive. Belive that you would get justice. Yes, you will get. pursue the matter. Get legal aid on your own or from the court.

When there is a dispute with regard to an immovable property, the dispute has to be decided on the basis of the Complete Revenue record available with regard to the said property in the district where the property is located/situated. Even if your presumption with regard to bias nature of judges in the District Court exist the judge adjudicating this dispute has to go through the Revenue record of the property not only those documents you guys of both side produce as your evidence to prove the ownership of the property. If this property which you claim belong to your parents & which is disputed by other party as it belongs to him, in such case even if a false documentary evidence is produced by the other party in the court, the very fact that what all the actual revenue record of the district where this property is situated has to be produced & checked to infer the correct position with regard to the ownership. The onus lies on you to summon the complete revenue record, show & prove the ownership of this property in your favor as per the revenue record. When this evidence is recorded on the record of your case, it will be very difficult for the judge in the district court to pass a wrong judgment in their favor even though such judge may be having bias attitude towards the other party. Even for some reasons a wrong judgment is given by the subordinate court, there exist higher court for going on appeal against the wrong judgment. If they can engage good lawyers why can't you? After all whom you call a good lawyer? A person who studies & prepares each case completely or just one who because of other extravagant reasons & press/media publicity became popular? Edit :- On the basis of information as conveyed to me that this property which your parents purchased was not got demarked by puting fence & its sale deed was not got registered. However only proof of evidence with them is signed deed of this land but not registered. As I told that revenue record as available with the revenue department of the district will only be considered as genuine evidence with regard to ownership of any property by any court, however if the sale agreement/deed was not got registered there will be a presumption that there was no conveyance of the property as the immovable property is conveyed only by registered sale deed to complete the transfer of such property legal & to ascertain the real owner of the property.

If they do not participate, then even an honest judge will rule against them because the honest judge will never hear their story or see their documents.  They should get a lawyer to help.  A lawyer who can have the documents examined for authenticity.  A lawyer who knows how to get a new judge.  A lawyer who knows how an appeal can stop a judge from acting unlawfully.

there are several higher forums upto supreme court.

definitely some judge honest will deliver proper judgement. all are not currupt

You have to employ a senior lawyer who has good reputation and you need not worry if you are a bonafide owner of the property and have all the legal documents in order in your possession. Even if the judge is influenced by the opposite party you can always go in for appeal, but only thing is it will tak time. You  can also consult a lawyer whether you can file a criminal complaint against the opposite party for duplicating the documents.

Keep your faith in the  Justice delivery system. You can not accuse a Judge of corrupt unless you have concrete evidence against him. You could be put to severe trouble for such vague alegations. 1) Your parents have to appear in court. Or ex-parte judgement will be given against your parents.

2) Have faith in our legal system. If you feel that your case has not been dealt in the proper manner, you can always file an appeal in the upper court.

3) Get an excellent civil lawyer.

.   This type of corruption forces people to emigrate from India.  There is nothing you can do except hope for an honest judge.
