How to take someone to court, or what would u do?

So first off i dont want to take her to court but i will if i have too. this is whats going on.

I moved into a new apartment and the internet there didnt work, we were always complaining about it and i had an online class so i had to keep turning stuff in late when the internet decided it wanted to work. So i sugested we pay for our own internet i asked everyone and they all agreed to split it.

Well every one payed me but, this girl, so i remeinded her and she said she would pay, shes very forgetful and is hardly home so i just kept waiting to get payed. well last months payment is due, so i thould them all i needed the money by friday and told, that girl, that she owes me for last month, and the month before last. every one but her said they would get me the money, she now says that her computer is broken so she has only been using ours and she hasnt used it that much so she doesnt think she has to pay. We have been arguing back and forward about it, and i really dont think she is going to pay. i tould her to talk to our other roommates and see if they will be willing to split her part and help pay for hers too but they wont, they think she should pay too. I dont know what to do, i kept all the texts incase its helpful i think i might have to take her to court but dont know how to do that. Thanks for any help you can give.

  1. You can take her to small claims court but if you don't have anything in writing it will be your word against her's.  All she has to do is say that she never agreed to those terms. If you don't mind spending the time and energy pursuing the matter then go for it. I would suggest getting a new roommate if she's not on the lease because going to court for a small amount of money, even if it's on principal, can be a major pain. If you can find some other way of penalizing her then you should take that route instead.


  2. If she originally agreed to pay her share and didn't then you should take her to small claims court. She violated an oral contract.  The local court clerk can give you the forms and there are plenty of resources online to get information how to file and pursue a small claims action.
