I am owner of a property that i want to move back into.How do i write a letter asking that my month to month tenant-(sister) move out?

  1. Get the legal stuff sorted, write the letter giving notice as the law says. Then arrange to meet and hand it to her personally, explaining why you are terminating the arrangement. (You want to move back in) Offer a written reference for her next property;

    You might even offer to help her find another place...

    Above all KEEP CALM.  She may or may not be upset but don't get dragged into an argument. With family disputes, in the long run, no-one wins.

    Bear in mind that you will have to face her and the family for many years to come.

    Keep a copy for your records.

    Give the tenant 30 or 60 days depending on your state/county/city laws (check landlord/tenant handbook)

  3. Can't you just tell her that you need your apartment back. them maybe room with her for awhile while she finds another place.  If you are not careful you could be making a lifelong enemy of your sister

Check what the laws in your State require.  In mine we only need a 30 day notice.  In the letter state that you will be terminating your lease as of x*x date according to your lease agreeement.   I don't know if she has a deposit with you or if you did a "move-in" inventory check but I would also address this with a final walkthrough that way there is not question where the carpet was stained, cabinets destroyed etc... Obviously if you didn't have a 'check-in' it will be harder to prove a 'check-out'.  Make sure you give her a copy of your findings at the time of the final walkthrough.
