How were the checks & balances & the separation powers involved in the repeal in 18 amendment?

  1. The 18th amendment (prohibition) was repealed by the 21st amendment.  Since this was an amendment that was adopted using the method proscribed by the Constitution it would have no relationship to checks & balances and separation of powers because it did not change what existed before. We still had an judicial branch, a legislative branch, and an executive branch of government.
