Question:

How would I go about adopting my fiance's unborn child?

She is an American citizen (for now), and wishes to have no involvment with the biological father... which by American law she has this right so long as she does not sign his name to the birth certificate... Could she put mine down? What are the legalities?

  1. you would make them write out a paper stating they are willing to let you adopt the baby and make her sigh the paper make sure it says she will not leave the sate until she has the baby and she has to up date you about the baby and give you sonograms of the baby and make sure she is not doing drugs or anything els  to harmer the baby

She can put what she wants of the cert, but if the bio dad wants to prove the kid is his, he just has to take a paternity test.  Then the only way you can adopt is if he gives up his paternal rights.  Are you not in America because I don't think you understand the laws.  It's his kid and he can fight for it whether she wants to be with him or not.  Unless he wants nothing to do with the child, you may have to deal with him.  I would have her contact a lawyer and get information about the putative father registry and information on adoption if the father's rights are terminated.

  5. Actually, that's not quite true. She has the right not to put his name on the birth certificate, but all he would have to do is get a judge to order a paternity test and prove that he's the dad, then he automatically gets visitation. He would then have to give up his rights for you to adopt the baby.

    Even if she writes your name on the certificate, he could still have it changed once a paternity test is done. She does have the right to give the baby her last name or yours so long as you're on the birth certificate.

    also, just because she doesn't want to be involved doesn't mean he's not willing to be involved.

She probably could but it wouldn't be fair to the child; a child has a right to know where they come from.  Please believe me because I am such a child.  I thought my dad was my dad and his name is on my birth certificate but when I was 24 my mother told me that my father was another man and I have longed to find him ever since.

  10. She can put you down on the birth certificate as the father. However to become a legal guardian you would need to adopt the child. You should think carefully about this though because if you split in the future and you have adopted the child, you will liable to pay CSA payments if she chooses to take that route. However simply being named on the birth certificate as father can be cancelled out by a DNA test to prove you're not the father where as adoption cannot.

    Um... she can put your name on the birth certificate. You'd be the legal father unless proven otherwise.  There may be some legalities to deal with later if bio dad comes back into the picture and/or you and the fiance split up.

  13. In the Uk it is illegal to knowingly put a false name on a register as its a legal document.  Its probably not worth it.  See a legal bod about the adoption/guardianship route.
