  1. you will never get it, if it's in any way harmful to their case. it will just disappear. trust me .............


  2. You can send a letter to the proper people, i.e. the Chief of Police asking for it under the Freedom of Information Act and they may make you pay for it, or you can subpeona it, it is a part of Discovery and if they have a case against you they have to provide it if you request it.  

  3. If your case has already been filed you can subpoena it, or try an open records request.

    I believe the answer to the question is that the Open Record statute in your state will allow you to request the copy of the tape. You may need to file an open record request with the department that filmed the tape/stop/incident.

  8. subpoena duces tecum (SDT) - this is a subpoena for records, which would include the video tape taken by police in their cruiser.  If you are representing yourself (obviously, or you wouln't be asking the question - any two bit attorney would know this), ask the court to issue an SDT for the video tape and any and all records of your arrest, the investigation, hand written notes, etc. etc. You have a right to the information if you are representing yourself in court.

  9. Subpoena it.
