Im just curious if anyone has any tips or any direction they could give me in the specific subject.Also How can I check if the name is already legally owned?

Search "intellectual property", "patent", "copyright" and "trademark" at the site http://www.fashion-incubator.com for how things are done in the US rag trade.  

Also look at http://www.uspto.gov/ -- you can search your names there, and there are a couple of nice primers on trademark and patent.
