  1. you'd be formally notified by the courts.  either you'd have to be in court when it was decided, or you'd receive correspondence of some kind.

  2. One would be informed of the fact in some official way

  3. You would get the order delivered to you by the local police department, who would be made aware of the situation.  They have to notify you.  If they can't find you, then the order may go through.  The order would give you a date to appear in court, usually within 10 days, so you can dispute it.  If the person that took one out on you has good proof, then the judge will extend the order for @ a year.  At court, you need to bring any and all proof that you aren't guilty so the charges are thrown out.

If you do get the restraining order, you cannot have any contact with the person.  Even if they say they'll drop it, they're sorry, what not.  You will be arrested.  Don't contact them, don't go near them, until you go to court.

  4. For a restraining order to be effective and valid, both parties have to be served with a copy, and the RO filed with the local agency/courts. Service can include hand delivery or first class mail.

If you don't know about it and the local courts don't have a record of one, then one doesn't exist.
