He'e never entered the Sates illegally. He was a student and his Visa expired. My quesion is if he goes home and applies from there how long will it take him to come back legally.. how long will it take to take care of business from there? Anyone know?

  1. If he overstayed on the F1 and is still here that may be the problem. An F1 is a non-immigrant visa and the student is supposed to leave when they complete their schooling or it expires.

    Since he married on an F1 he has demonstrated he intending on staying.

    He needs to return home ASAP.


  2. I don't care how long it takes.  He needs to stay right where he is.  If he leaves the country the papers you filed will no longer be any good.  He'll have to start over.  Until you here something do not do anything.

    There is absolutely nothing to stop him from getting his green card if he was here on an expired F1 visa / I-20.  Just as long as you filed the I-130, I-864 and G-325A, and he filed the I-485, I-765 and G-325A, you're okay.

  3. i am not quite sure - GOOD LUCK THOUGH ... i moved here in 5th grade and it took me and my family almost 5 years to get my green card just because they lost my paperwork so many times and my stepdad was deployed a few times so he couldnt be there for the meetings
