Question:

Husb filed for divorce. I got papers. It came with an order of mediation......?

What does this mean? Our divorce will be pretty simple, no kids, and only asset is house to split 50/50. I'm in Tennessee. How will mediation work? What should I do now?

Dont say get a lawyer cuz I already know that. Please answer only if you have specifics or you have good advice.

I am a lawyer in Alabama and am in mediations every week.  Mediations really aren't a big deal and there is nothing that can be forced on you without your consent.  If you are planning on getting a lawyer, which you should, then he/she needs to be present at the mediation.  The court can order you to go to a mediation, but they can't make you agree to any terms.  If  everything is pretty simple in your divorce then mediation is probably the best way to go.  The biggest issue would be who keeps physical possession of the house, but also remember there are a lot of items in that house and you need to decide who gets what...

    Normally, the profits on the sale of the home are split and the person keeping possession of the house needs to keep paying the bills up until that point.


  2. Mediation is a good deal because you sit down with someone and try to negotiate a settlement.  The mediator can't order you to do anything if you don't like what they suggest.  Give it a try.  Good luck.  

  3. the mediator helps negotiate custody or parenting time issues, child suppport, property division, alimony and post-decree modifications.

  4. Mediation is where you sit down with a neutral party and agree to the terms of a settlement.  It is to save the judge's time.
