Question:

Husband in military but want guardianship of brother.?

my mother wants to give me guardianship of my 16 year old brother.

what would we have to do to get legal guardianship of him.

my husband is in the navy and we live on base. so in order for my brother to come on base he needs a military id..but we need guardianship of him.

does anyone know what i would have to do to obtain legal rights of him?

  1. With all due respect to Yahoo Answers, as a retired military guy I suggest you talk to the JAG on the base. I am sure you can do it but, you shouldn't rely on this forum to find out how. You will need a document to prove that you are his legal guardian and as far as the military is concerned your husband would be responsible for everything the boy does on the base.


  2. Air force would require you to go to the Family support center. Someone there would be able to help you out there. If he were to talk to his first sergeant equiviliant I am sure they would help too. Since he is married, I wouldn't see this being a problem.

  3. court order.  and Guardianship would only work to allow him to live on base.. you would need CUSTODY in order to get him Tricare bennies and an ID card and have him counted as a dependent for PCS purposes,    

  4. The first step that you want to take is to get guardianship of your brother. You can seek legal counseling from the legal department at your base (which should be free) and they will let you know exactly what you have to do. After that is complete you can go to the DEERs office or customer service center and show the court documents stating that you are your brother's legal guardian. That should be enough to get him into the DEERs system and get him an ID Card.
