I 129f and the spouse visa?

hello all my fiance filed the i 129f 9 month ago now she is leaving usa to come so we can get maried please tell me how lnog is gona take after we get maried to be together in usa and can we jsut go to the usa embassy and file there since she is a usa citizen can we both go together to the us embassy and file for it thx alll for your help

  1. If your K-1 process is already completed and you have the visa on hand you can't get married in your home country.That would defeat the purpose of filing for K-1 or fiance visa.That visa is for the purpose of the non-citizen fiance/fiancee to come to the US to get married here within 90 days upon arrival. If you are going to get married before you come over here in the US you may have to file again for spouse visa this time.


  2. Why do that?  If you get married, now, you will not be eligible for a K-1 visa.  I do not believe you can change the application from K-1 to CR-1 by getting married after the application has been filed.  George and Doghorsemom can give you a definitive answer about this.

    Your fiancee cannot file ANYTHING at the embassy.  Only a US citizen who lives abroad, permanently, can do that type of filing.
