hi, i filed I-130 and 1-129F at different times, but they got approved at the same time. Now both the approved letters say they will sent it to NVC ( i think ).

So would my spouse in myanmar receive 2 interviews ? or what is going to happen next ?

if there are 2 interviews is it ok to not go to I129f interveiw and simply go to I130 and get that visa. Instead of Kvisa ????

please help me

thanks

  1. no, she'll only get one interview in Yangon. If she comes in on the K-3 then she'll have other interviews in the US later on. If both petitions are available at the embassy, they'll process her on the I-130. If they have the I-129f and know the I-130 has been approved, they'll give your wife a choice of going on the K or waiting for the I-130.

  2. The purpose of the K3 visa is to get the alien spouse to the US while the I-130 is pending.  For CIS to adjudicate the two petitions together is illegal IMHO as it defeats Congress' expressed intent in creating the K3 visa.  You might as well just go for the immigrant visa (I-130 case) at this point because - as I just described - the purpose of the K3 has been soundly defeated by the new procedure.
