I-130 submitted March 2003 for unmarried son over 21?

Petition approved on June 2007 per AOS - case at the California SC. December 2007 letter from overseas consulate received by beneficiary confirming approval of visa but said visa not available so wait until further notice. That was almost 7 months ago. Any idea on when an appointment letter or whatever next step is will be heard from? Possible 2009?

  1. unmarried son, is considered to be an adult


  2. I-130 was approved with the Priority Date (PD) of June 2007, I assumed. According to Visa Bulletin (VB) of July, Family Preference 1 category (Unmarried Sons and Daughters of US Citizen), person who has PD of on or before March 15, 2002 can apply I-485 real green card application.

    So you need to wait about 5 more years more or so.

    By the way, USCIS won't send you anything or notify when to file I-485. When your PD becomes current according to VB, you file. So keep checking on VB.

  3. You should call USCIS and ask them. Or make an appointment.
