I'M I LIABLE IF I USE MY INSURANCE AND COME TO FIND OUT THE COMPANY DIDN'T PAY THE PREMIUMS.?

I USED MY INSURANCE IN FEB. COME TO FIND OUT THAT THE COMPANY I WORK FOR "FORGOT" TO PAY FOR JAN. AND FEB. THEN SWITCHED IN MARCH TO ANOTHER CARRIER. NOW I'M GETTING BILLS FOR THE DOCTORS VISIT. ISN'T THE COMPANY YOU WORK FOR SUPPOSE TO GIVE YOU NOTICE IF YOU DON'T HAVE INSURANCE???

  1. she is liable till the time you are working with her after leaving her job she is not interested to own her liability


  2. Yes-they should. Submit those bills to your employer. They should pick up those costs. Of course , you should get this in writing from them and follow up with the doctor's office to make sure they have been paid.

  3. YOU ARE ALWAYS LIABLE FOR SERVICES YOU RECEIVE, TO THE PROVIDER.  SO YES, THE DOCTOR CAN COME AFTER YOU, AND WILL EVENTUALLY SUE YOU IN COURT, AND WIN.

    YOUR EMPLOYER DOES NOT HAVE TO GIVE YOU NOTICE IN ADVANCE,  HOWEVER, THEY CAN USUALLY BE SUED FOR THE COST OF WHAT THE INSURANCE WOULD HAVE PAID, UNTIL THEY TELL YOU OOPS WE GOT CANCELLED.  THIS IS CALLED EMPLOYEE BENEFITS LIABILITY.

    YOU'LL WIN THAT SUIT, IF YOU CHOOSE TO SUE THEM.  YOU CAN'T 'OPT OUT' OF LIABILITY.  YOU CAN GO TALK TO A LAWYER, SEE IF THEY'LL WRITE A LETTER FOR YOU FOR $25 THREATENING TO SUE.  YOU LIKELY WILL HAVE TO SUE THE BUSINESS, AND YOU'LL PROBABLY WIN.  THE PROBLEM IS, ESPECIALLY IF THEY'RE FILING BANKRUPTCY, IT'S GOING TO BE DARNED HARD TO ACTUALLY COLLECT ANYTHING.
