I'm I entitled to a refund on ebay even when the seller says no return?

I bought a sat nav a few days ago, on the description that the item works perfectly, when I had it delivered it the item didn't work at all when I tried to charge it for 10 hours.

Even though the seller had "no return" he can't just sell things that don't work and get away with it like that, or can he?

  1. Get in contact with him and if he refuses to give you a refund then claim one through paypal. They'll get you your refund, presuming you used Paypal, that is.

Well, yes and no... basically on e-bay goods need to be as described - that is a very basic rule of trading, and selling something on e-bay is no different.  So you are perfectly entitled to demand a refund.  However, that's where the fun starts.  If the seller refuses, and you have not used Paypal to pay (which offers certain guarantees) then all you can do via e-bay is report the seller as selling an item not as described and e-bay will give him a warning, and that's about it.  You would then have to pursue your refund through small claims court as you would with any other trader who failed to supply saleable goods.

  3. Is there anyway that you can report this to some one on E-Bay.  I would have thought the buyer had the same rights, as if they had bought from the shop. I would be interested to know how you got on.

  5. You bought it as is and he forewarned you that there was no returning it. You should of been leary of buying something where the seller says no returns, he knew it was broken and you fell for it.

No, he can't.  The Sale Of Goods Act dictates that goods should be fit for purpose (ie a sat nav should be able to tell you where to go!) and of merchantable quality (ie at least of use for something - which this clearly isn't.) You are quite within your rights to demand a refund, and if he gets shirty, you could pursue him through the small claims court.  Ebay should also be able to advise you.

    ive made loads of money so far.

    and they don't suspend you like ebay do. and also everyone i dont know if you have heard but ebay are susending users randomly, and they say you can apply for your account to be reinstated but when you contact them they dont answer emails and they wont reinstate your account so dont waste the paper.

  8. Get in touch with ebay by hovering over on help on the ebay page at the top right andf clicking contact us. Even if the seller has put no returns, the item must be fit for the use it was sold for. As it is not working it is not fit for the use it was sold for.
