Question:

I'm a sub-leaser I seek my deposit back...?

The landlord is a private owner of the house I rented a room in.

I payed the person I sub-leased under half of the deposit. I called the landlord and received no response. I emailed her asking what was going on and she told me she was having problems as well as her room mate whom was my former room mate in the house.

She called twice and received no response. I called again today with the caller id block code in case they were screening calls, no answer.

I'm afraid to do this but I made the agreement with the sub leaser and I have to sue her for the money. What I need to know is how long is too long to get the deposit back? And how long should I wait til I start a suit?

  1. In most states the landlord, in this case the lease holder, has 30 days to either refund the money or give you a list of damages.   In CA they have 21 days.

    You can not file prior to that date, 21/30 after you vacated the property.
