I'm being harassed by my tenant? What can I do?

My tenant is harassing me by calling cops on me stating that I'm loud. I have 3 kids here. I am really scared that she will vandalize my stuff. I have not harassed her in any way. I don't even talk to her but she supposedly has a restraining order on my husband and I. I have not gotten any paperwork from anybody. So do I go file paperwork to the court or just leave it alone. I want her out due to the act I'm scared for me and my kids. And if so what kind of paperwork or forms to fill out?

go to your local d.i.y store and buy an axe, some rope, some plastic sheets and a couple of shovels... I'm sure your imagination can tell you what to do from there....

are you renting straight out to this person? all you have to do is give her a thirty day notice...make sure that it is notarized and send it to her by registered mail so that she knows that she cant say she didnt get it.if she does not move out then you have to take her to court..you could actually on grounds of harrassment..if she had a restraining order against you and your husband you would have been served ....she sounds like a huge problem

I would first try to sit down with her and ask her what's wrong first.

Unfortunatley you can not file court paperwork until you have given her a notice yourself, if you rent by the month 30 days, 2 weeks for bi-weekly, or whatever it says in your rental agreement. If the tenant fails to leave after that then you can file a formal eviction with the court. There is no restraining order, if there was you would have recieved paper work from the cops/sheriff. If you have legitimate examples of harrassment you may be able to contact the police yourself and see if you can go straight to court paper work. Good Luck, and I would start writing down dates and times of any contact you do have with the tenant, especially if they are being threatening.
