I'm being sued by a debt collector. What do I need to do??

I received in-person a summons and complaint by the state of ILL where I'm being sued by a debt collector. I have 3 days before Aug 06 to file a written answer to the court. What does that mean and what exactly do I need to do? I owe $2900 some dollars that I do not have.But i made a playment plan w/ the debt coller since july 25 and receided the summons an the 26 of july.. i call them up told them why the sued and told me that went i had spoke to them the law sued was send and they culd't stop. they told me they there not going to sued me and that i have only sing a agreement of monthy playment and that all. That they will send to court .. Do i do what they said? or what cant i do? Please help, and only serious answers. Thank-you for your help..

  1. If you received a summons you need to appear.  But as far as this payment arrangment..something does not sound right. Why would they agree to a payment plan and then sue.  Do you have somehting in writing about this agreement or did they say they would send something to sign?  I'm confused about the details here.  Bottom line is if you are being sued you need to go state your case and bring all documentation with you.  You will not go to jail, but if they win they can legallly garnish your wages for the $2900.  More detail, calmly, would be useful.


  2. They will set up a payment plan,but don't agree to an amount that you can't afford to pay.If you can only afford $20.00 a month,then they'll just have to accept it.

  3. Absolutely do NOT sign anything this collection agency sends you. If they take this to court they'll use this signed document against you and they'll almost certainly win a judgment against you....

    You absolutely need legal help to file a response to the court. If you don't have any money, contact your local Red Cross for a referral to free legal aide in your area. They "may" be able to help.

    DO NOT be a "no show" on the court date under any circumstances....even if you are scared or you have the flu....show up anyway......If you don't show up the other side will win on THEIR terms...They'll get a default judgment and your wages could be garnished up to to 25%.........Even if you loose....if you show up you can probably get better repayment terms....
