I'm canadian and my BF is american. I need help on getting his permanent resident status. help?

Our situation is SO complicated. Basically we've been visiting eachother back and forth for the past year or so. I quit my job last year so i could stay with him for a while, i stayed there for 5months then i came back to Canada for 2 months and went back to see him in USA for another 5 months. Now i'm back in Canada and i want him to move to to Toronto with me. The thing is, i'm living in Quebec City with my parents. I want to move to Toronto and he's currently working for an online company thats based in Toronto. I've looked in to Sponsoring him as my common-law partner, but i don't have a job right now so i can't do that. So i figured he could get Permanent Residence through an employer.. I'm wondering if his current boss can Sponsor him for his Permanent Resident status. If we do it that way, i'm not sure what forms he has to fill out, there are so many different choices. Basically, i need someone to help me find the quickest way for us to be together and both working in either Canada or USA (preferably Canada).

  1. Have you thought of moving to the US permanently. You can also look into doing that. Have you graduated from University? Do you have a degree? If so you can look into the NAFTA TN visa. You can also look into the Finance visa if you were engaged.

  2. If he can be described as a computer systems analyst and can get a job in Canada as one, he can apply for a TN visa to work in Canada. Just do an internet search for "TN Visa"

    If he does not qualify for a TN visa, you seed to speak to an immigration consultant.


  3. Well, to start you cannot sponsor him as a common law partner because the rules state that you must be currently living together for 12 consecutive months (Canada family class).  

    The post above me is also correct on saying to beware if you are living in Quebec.  They have their own set of rules--much more difficult.

    It seems the best thing to do is for your bf to get in on his own with his employer as his sponsor.  You can look up all the work visa's on the Citizenship and Immigrations Canada website at www.cic.gc.ca

    Some work visa's are temporary and some are permanent so pay close attention.

    I came to Canada from the US to be with my husband.  I am now a permanent resident here.  It is a long process and sometimes it can be difficult.  Good luck.    

  4. You can sponsor him, but use his income as qualification for the requirements.

    I got dinged on an inland sponsorship. What he could do (and was mentioned above) is to work on a NAFTA visa and then marry you and switch over to inland sponsorship.

    Or you can do it the proper way with an out-of-land sponsorship and he can still visit you, but you sponsor him and he uses his income.

    If you do the 1st thing, or your idea, it's called dual-intent. That sort of thing is liable to get him barred from the country. They don't like people getting one visa when they can't get another.

    Another thing is that you live in Quebec, which is a big problem with immigration as the province has their own laws above and beyond the federal laws. Because you legally reside there that is where you will have to sponsor him there. Be careful.

    Finally, if you are really serious, keep in mind that you are on the hook for his welfare for years after he is approved. If he goes on the dole, YOU have to pay back every penny he takes from the gov't.

    I think you should move out of Quebec, to Ontario, near Toronto and get a job and a legal residence. You should start an out-of-land sponsorship and you should hire an attorney to handle this. You need to protect yourself, him, etc.
