  1. yes it always stays open. i know this because i have given up a couple of babies for adoption.

An open adoption is only as good as all the parents who signed it.  Legally, we have a closed adoption, however, we had talked with the birth mom about being a part of the baby's life.  She did a dose of meth in order to have him faster, and because of that, we drug test her before she comes over (she had a history prior to the pregnancy).  She came 2 times, and hasn't called or anything since, although we've seen each other a couple of times in public.  The birth dad makes an effort, and gets pictures, and so does grandparents.

    Anytime a birth parent endangers, or upsets the child, whatever is in the best interests of the child is what should be at stake.  No one in the equation should EVER make the child feel put in the middle, and if that happened, it should be the end of the open adoption until the child is old enough to comprehend what is going on.

  3. In most US states, an open adoption is unenforceable.  It can be closed at any time for any or no reason by the adopting parents.

  4. from my experience, the agreement signed between both parties beforehand is what is used to determine throughout life.

  5. For the most part it is always open. What ever the Birth parents Choose is what happen. My child that i will be giving birth to is gonna be Open adoption.

Some states practiced open adoptions, while other states practiced closed.  One particular state, Ohio, originally had open adoptions, where it was very easy for the adopted child to find her birthfamily.  Then, a group of pro bono attorneys, some of which had adopted babies, decided to change their state to closed adoptions, making it much more difficult to find one's birth family.  However, there are still ways.

    One of the search angels that I work with is on the board in her states.  She is constantly sending me new legislature from different states, which does change.  To my knowledge it has only changed to open adoptions.

  7. OPEN ADOPTIONS can be closed at any time by the adopters for no reason at all.

    They are NOT legally enforcable.

    Research HB7 in Ohio it is the first bill I know of that is in house, if passed would legally enforce open adoptions.
