I'm getting married and I need to apply for permanent residency for my fiance, but I don't know where to start

I'm getting married in a month. My fiance is Canadian and I need to apply for her permanent residency or new visa. I have no idea where to start. I was wondering if people on here would have any good answers and advice on where to start, who to contact, what forms I need to fill out and other stuff like that. I appreciate any help.

  1. First of all, what country are you in????

    well, where ever you are, Go to an immigration office in your city. Maybe a governent building like a City Hall. They will point you to the right direction.


  2. Go to www.uscis.gov/   .  I had to go there in order to get a fiance visa for my wife.  This cover green cards, immigration visas, and etc.

  3. I am a legal assistant and have worked in my profession for 14 plus years. You can get the pass port from the U.S. Post office. As your new bride/wife in a month, she will have all of the rights of a U.S. Citizen. Any children that are born to your union will also have duel citizenship and they will not have to choose which country to belong to until they become of age. In other words if they are born here they will be Americans that have the option to claim citizenship in Canada later.

    This union will also give you citizenship in Canada or at least citizen priviledges. Is there a reason that she would want to give up her citizenship? The Canadians are our allies and I don't forsee any problems with your new wife living in this country other than taxes and voting rights.

    Other than that you could contact immigration to be sure but, first think about having duel citizenship. Also, residency does count I believe the standard is 6 months. Get married before you talk to immigration.

  4. If you get married while she is in the US on any type of visa other than a fiance visa, you trigger a marriage fraud investigation and delay issuance of her permission to enter the US.  It can cost her any chance of getting a green card. Don't even think about getting married next month.  

    She must remain in Canada while you apply for the fiance visa.  You must prove the validity & duration of your relationship, and must prove you have sufficient income and assets to support her and to guarantee a $30,000 bond.

    Once the fiance visa is approved, she can enter & you have 90 days to marry and file for a spousal visa.  She will probably get temporary permission to remain here while that visa is processed.

    If you try to get married while she is on any other type of visa or visa waiver, you two are toast.

    And consider the ramifications of getting married with no authorization from US immigration authorities: did your fiancee enter the US with intent to get married, or has she been here legally for a while and you two simply decided to get married? If it's the former, then you can't get married and apply for permanent residency. That's immigration fraud because there is a specific visa type designated for people who wish to immigrate with intent to marry a US citizen.

    If on the other hand your answer is the latter of my two options, then definitely look at the link I posted above, that will fill you in.

    You simply need to get married by obtaining a marriage license from your local city hall or whatever, and then start following the steps described in the above link.
