I'm getting sued!?!?!

I got into a car accident the other day a lady impacted me from behind while i was entering the highway. The police said it was my fault since i didn't have a license, just the test to prove I had passed the license. The lady was the first to get out of the car and seemed in a fine state other then being mad. Now it seems very odd that she has not claimed the money to fix her car and we understand she is preparing to sue, she said that her neck hurts and that she has suffered emotional damages.Now the problem resides in the fact that I'm only 18 own nothing, i don't even work. My parent said that she will emancipate me if she has to in order to not pay. She also refuses to pay for representation. How would a pay this woman i don't even have an ATM ( no money nor property). What can I do?

  1. A good lawyer can definately help you out - but it really hurts that the police have ruled it your fault.


  2. If you are 18, you are already emancipated. The only way that lady could sue your mother, is if your mother owns the car or her name is on the insurance. If you have liability, the money would come out of the insurance. If you didn't have insurance, which would be illegal, then they would garnish your wages if she obtained a judgment against you, assuming you have a job and if she wins the suit.

    Your insurance company usually takes care of all this and they will have lawyers working for them. You should contact them and if they aren't helpful, you might need a lawyer but if you can't afford one, I don't know what to tell you. Call your insurance company though.

    But don't admit fault to anyone!!! The police report is not the deciding factor.

  4. Do not listen to that cop not having a license does not make you at fault

    you were hit from behind it is her fault

    get your license get a copy of the police report

    and explain everything

    the cop saying it is your fault has no bearing on a civil case

    you should file and sue her for your damages  

  5. If you have insurance, she'll sue them before she sues you. If not, then she'll go after who ever she can. I would suggest your parents look into a PrePaid Legal plan.   6. Don't know which state you're in, and that could change the answer plenty.

    Own nothing and don't even work? what's to worry about? Really - what are they going to get? After all the drama plays out file BK.

    If the lady had Uninsured Motorist, she wouldn't have put herself in the position of depending on an own nothing, doesn't have a job indiviual, like yourself.
