basically you could marry them and then they would have to go back to their country and wait for the paper work and then enter legally.  Or they could go back and enter with a fiance visa.  Either way if they entered the country illegally they will have to go back and enter legally.  If they entered legally and their papers just ran out then they would just have to adjust their status.  That website has the names and instructions of all the paperwork etc.  and you can ask question to people in the same situation.  Good luck!

If the person you want to marry entered the USA legally with a visa and is now out of status it is possible to marry and correct the status. If the person entered the USA without inspection then you don't have that option.

Your CO can provide you with help with the paperwork but you might be advised to talk to a qualified immigration lawyer before you do anything. Having a non USC spouse can also affect your security rating at work so you need to consider this before you jump into marriage.

If you can't afford a lawyer contact your local Catholic Social Services, they provide high quality immigration lawyers and charge according to income. You don't have to be Catholic to use them.
