I'm not at fault and the insurance company wont pay for the damages !!!?

My girlfriend was recently in a car accident, she was sitting at a light when suv ran into the back of her car( damages is about 4000 dollars) The suv push her into another car into another car in fron of her( only the bumper was push it)-

The issue is this, the insurance company of the SUV do not want to pay for the damages, when the police report clearly state she was wrong and she receive a ticket for reckless driving. The insurance company stated that they wont be liable until they speak with the 3rd party of the accident. The claims agent explain that they are trying to contact the 3rd person but they are having no luck, We were able to call the 3d person in the accident and got them on the 2nd ring. The body shop stop working on her car because the insurance refuse to pay them for the car. Now the thing is this……….. my girlfriend don’t have insurance on her car………………what can I do? Who can I contact…lawyer is last option I want to pursue because of the cost.

  1. Contact your local board of insurance and have them open a case against the insurance company, this happened to one of my customers and once the board of insurance got into the picture, things started looking really good.


  2. Since most states require you to have insurance on your vehicle, I'm wondering why your girlfriend doesn't have insurance. Because she may be in breach of the law (if your state requires drivers to have insurance), you may not be able to get a lawyer to help. Also, if you live in a "no-fault" state, the most she'd be able to sue for would be $500 (because if she had insurance, it would be covered by her insurer). Has the insurance company seen a police report? I don't know why they'd need to talk to the 3rd person, if it's in the police report that it is the SUV's fault. I'd take a cop's word over the 3rd person any day.

  3. Get a lawyer. If the car isn't going to be payed for, it's considered totaled. She has a really good case- you won't have to pay upfront. They will take about 33% of your settlement.

  4. Well, you could contact the "third party" and give them the information of your insurance and ask them to contact them as the insurance company is having trouble contacting them.

    Unfortunately, a big chunk of it might just be the bureaucracy that insurance companies are famous for. Sometimes they just won't pay up even when they have a contractual obligation to do so. Try getting the third party to contact the insurance company. Then give it a few days, if they say that no one's contact them then double check with the third party. If they say they have, then it's time to lawyer up.

    It's sad but insurance companies don't always do what's right and in my experience look for any reason to not pay. My brother got in a car accident and our insurance tried to drop our boat insurance... Gives you an idea of how these people think, and I use that word VERY loosely.
