I've a visa J1 and it says that the two years rule doesnt apply. May I stayin USA What can I do to stay legal?

  1. The Two Year Rule does not apply to letting you stay in the US after your J-1 visa expires - it simply means that you do not have to wait out of the US for two years before you may apply for another visa.  You must leave the US within 30 days of the end of program.


  2. as mentioned in the answer to your question above, you have a grace period of 30 days to leave the US.

    the 2-year home residency condition means that you would have to wait 2 years before you're able to apply for an immigrant visa classification, i.e., you can't initiate any process to immigrate to the US. however, you could still apply for non-immigrant visas during the 2 years, such as visitor's visa. if you wish to remain in the US still, you may want to inquire about a home-residency waiver, by which your government would communicate to the USDS that your services or expertise would no longer be needed, etc.

    check with your host university.
