I've wrkd for a MNC for abt 1 yr & rsignd. da cmpny isnt givng me sttlment amt. whm to aprch? im in B'lore Ktk

Even after 2 months of my resig the HR people are just playing and not providing me with the final settlement amount.

Whom should i approach? Labour court? Kindly guide.

The company i worked for is ITC Infotech, Bangalore, Karnataka - India

  1. Dear Friend,

    I could not understand your problem clearly. As you have worked about for one year, the Company need not pay you any thing except the back wages. Even then if you have not given mandatory 30 days or 60 days advance information, then the back wages will also gets forfited.

    As you have worked for only one year, you are not eligible to get encashment of leave ( earned leave ) and graduaty. you will not get any bonus as the same has already been adjusted in your monthly salary.

    You will get only the Provident Fund, which the Company has deposited with the P.F. Office. To get back the same, you have to approach the Provident Fund Office or you can provide the PF number to the new employer, so that your account will continue.

    Even then if you believe that the Company has to pay you certain amount for the reasons better known to you, you are free to send a notice by registered post on your own, giving details about the payment due to you and informing them to settle the same with in a specific period or else you will the forced to approach your legal consultant. I honestly advice you to meet the HR manager, before taking any step, other wise the issue may back fire at you. Take care.
