Hi, I just file I-130 and I-485 for my parents concurrently few weeks ago. One of the initial evidence that require for I-485 is Police Clearance. I spoke to my parent country consulate, it is going to take 3months for us to get it, another option that recommend by my parents country consulate is try to get a letter from their home country local police station to prove that they are not involve in any crime. So I sent in the I-485 package with the police letter from their home country.

However, I just received a fingerprint notice for my parents. Does it mean that USCIS already accepted that police letter as police clearance? I am not sure If i should take my parents to apply for another police certificate from Malaysia consulate, just in case if USCIS prefer other type of police certificate. :( please help.

  1. Are you sure that Police Clearance is required for your parents?  As parents of a US citizen then they  need to get police clearance only if they entered the US illegally.

Here's where I get this information:

If you look at point 6 in the instructions for the I-485 http://www.uscis.gov/files/form/i-485ins... it says that you only have to submit police clearances if you belong to a "special class" as given in the supplemental information.

The supplemental information says that a citizen's parents  belong to that special class that needs police clearance ONLY IF the parents entered the country illegally.
