I AM MARRIED TO A PERMANENT RESIDENT AND FILED 1-130 ABOUT 3&1/2 YEARS AGO.MY CASE IS STILL PENDING.

WE HAVE AN ATTORNEY HANDLING OUR CASE.WE WERE NEVER ADVISE TO FILE THE 1-485 ALONG WITH OUR 1--130.WOULD U SUGGEST THAT I SHOULD HAVE DONE THAT.IS IT TOO LATE.AND IS ANYONE ELSE EXPERIENCING WHAT I AM GOING THROUGH.

  1. You should have just did what the Mexicans do. They come over here and get everything they want, no problem. Dont file any paperwork and dont worry about it. Just have a baby and your in.


  2. USCIS is processing I-130 Application of Spouse or Child of PR filed January 1, 2005.

    Once your I-130 is approved, your will be given Priority Date (PD) and unless your PD is current according to Visa Bulletin (VB) by Department of State, you cannot file I-485. You will be Family Based 2A Preference.

    According to August VB, even though you have PD of today, you have to wait about 5 years or indefinitely if you are Mexican Citizen.

    Also you should ask your lawyer about the procedure.
