So heres the thing.

(im 15) I went to go bikeing with my friend,

he was behind me while we were bikeing down the parking lot.

i was about to brake while heading to the sidewalk, in the intersection. my finger sliped and i didnt brake, so i basicly

when right into the intersection,

Now theres this Van, that went through a red light (I THINK)

but either way, it didnt stop, didnt check to see if intersection was clear,

and acelerated doing 30, Then hit me.

it pulled my bike down and forced me to smack right into the hood, and then i rolled off.

When i was off i looked at my friend with a wtf just happened face.

and look at the car, the passenger (not the driver) came out said,

"Are you allright?" and i said i dont know. Then she said okay, and drove off. luckly someone behind her followed her and got her license plate.

I phoned the police and went to the hospital. and hes giving me a fine for bikeing on the sidewalk... and he still has to talk to the driver.

Will my bike be paid off?

  4. It was actually your fault so they can't be hit for the initial incident but they can be fined for leaving the scene of an accident.

  5. since when was it a violation to ride a bike on a sidewalk? i mean maybe in the middle of the city but i wouldnt think so everywhere else.

  6. IF they find the guy and you sue him, yes. you could even sue him for your hospital bills, which i'm sure you are.

    that sounds horrible. i am so sorry you had to go through that. i'm glad you're okay though. and by okay, i mean alive.

You have admitted riding out into the intersection, and the way you describe it (with your finger slipping) without any attention to traffic conditions.  You don't know if this van driver ran a red light or not,  You were fined by the police.  It seems from your story that you are the one who would he held responsible for the accident and that the van driver could actually sue you for damage to his van if there was any.

    Now as to the van driver's actions. He has left the seen of an accident and also failed to stop to give aid to someone who was injured (fortunately very minor by the sounds of it).. He will be in serious trouble for that. and face police charges far more serious than your fine. Unfortunately for you I don't think he will have to pay for your bike as you caused the actual accident. If he had definitely gone through a red light and you could prove it things might be different.

    I am just glad you are ok and now realize how easily an accident can happen. Be thankful you are alive and don't have a serious injury.

Maybe..if the other guy got a ticket..you may have to go to small claims court...this would cover your bike and your injuries if you are owing money or  maybe PAIN and Sufferings...you may take a year to make a claim..you never know if you twisted a back bone (etc etc internal injury..)Trauma"_(_)  if the police gave you the ticket it is a pretty lame reasons to sue..as you are basically at fault.

    How can a cop give a ticket when he actually did not see the

    accident?  This sounds fishy...but when it doubt..sue
