I VE BEEN CHARGED WITH COMMON ASSAULT,AND HAVE TO GO TO COURT NEXT WEEK .WHAT THE COURT WILL DECIDE?

  1. depending on your record, you may get a fine or probation. Depending on the circumstances also. Where you defending yourself or did you start the instigation by swinging first. I wouldn't really worry if you don't have a record.

It depends on the degree of assault and your prior history.  If it is a simple 5th degree assault and you have no priors, you will probably get probation.  But it all depends on the jurisdiction and your past history.  Chances are you will be sentenced to probation and given minimal jail time if any at all.  Just be respectful to the judge and remorseful of what you did.  If your an *** to the judge or too cocky, they could give you a harsher sentence.  But I honestly wouldnt worry about it if you dont have any priors.

  4.      Your question is impossible to answer without more details.  If this is a first offense, likely you could get probation or community service.  If you have priors, then jail time is a lot more likely.  If there are factors in aggravation or mitigation, these are all factors that the court considers in ajudication of each case.
