I WAS ORDER TO LET MY SON SEE HIS FATHER BUT HIS FATHER IS NOT SHOWING UP FOR THE VISITS WHAT DO I DO

SOMEONE TOLD ME TO FILE A ORDER OF THAT FINDS HIM IN VIOLATION OF THE ORDER HELP ME

  1. So the father is not showing up for visitations..keep a complete record of all of the times he doesn't show up. I would check with the courts on this matter and see what they say to do. No court can force him to take the child. Maybe you would consider asking for a modification of stopping the visits since he is not using them. See if this continues with him not showing up..

You were ordered to make your son available to his father for visitation.  His father was not order to take advantage of visitation rights.  You are making him available, therefore the order is not being violated (your obeying it).  The court cannot force him to use his visitation right.  The only thing the court can force him to do is pay child support.  Since you had to be ordered by the court, I assume you didn't want his father to see him.  If that's the case and you didn't want his father involved, your getting what you wanted.  Why fight it?

You can file a contempt order against him as long as you have written down all the the dates and times he has not showed up.Best thing to use in court is a journal for exes such as yours.Believe me I'am going through the same thing.If you can gather as much evidence to prove he has not had a father/child relationship he can have his rights taken away and deserves to if he is not going to have anything to do with your child anyways.I would also suggest you get a tape recorder and each and everytime he is to call to say he can't pick your son  up you have him right there on tape to present to the judge.But before you record advise him he is being recorded and  also say the date and time on the recording.Good luck.You might be in for a battle of your life!!!(I divorced my husband 5 yrs ago and it is still pure h**l with that man.He does not show up to get his children either and then 2 1/2 yrs later he decides he wants them.Come on where is the justice system these days?What happened to looking out for the best interest of our children?)Anyways I wish you the best

  5. Document it with dates/time/locations and copious notes in case he ever accuses you of keeping his son from him.

    You have an order to allow the visitation. However, the father is not violating it by not showing up.

  6. Have it documented everytime he does not show up, I am sorry for your son.  Contact your attorney if you have one and let them know of your current situation.

  8. Report this to the court and to your attorney. Also DOCUMENT EVERYTHING. Every time he doesn't show up, if he's late, etc. It's all a legal record.
