If I advertise my company on my car, when I do my taxes can I deduct ALL mileage (personal use included) since all use of the vehicle will inherently include business advertising and therefore also be business use?

  1. personal mileage and commuting mileage (first and last business trips of each day) is NEVER deductible for business

  2. No.  The cost of the advertising is the sign.  Business mileage will be only the trips that had a business purpose.  Personal trips are not deductible, whether there is advertising on your car, or not.

  3. register it under the company name

  4. No.  Your only deduction is for the cost of the sign or the lettering on your vehicle.

  5. No.

This was the subject of a pretty well know tax court case a while back.  The taxpayer took a deduction for all of his miles stating that the business purpose of the trip was advertising.  The IRS disagreed.  The taxpayer appealed to the Tax Court but lost.

Bottom Line:  The fact that there is advertising on a car does not convert personal miles in to business miles.
