I almost choked on an anchovy at large chain restaurant. Should I forgive them or sue them?

  5. The restaurant is at not fault here; they weren't neglectful and didn't harm you in any way. You are responsible for eating your food in a way that isn't dangerous.

  7. Well, it really isn't their fault. You could have cut it. They did not do this intentionally, so just forgive them and be more careful.

  9. You can't sue them or file a claim, because they are not liable here.  I work in a claims office as a claims investigator and trust me it would not even be worth your time.

    If you are sue-happy and you decided to proceed, then the claim would be submitted to their insurance company and the insurance claims dept and the attorneys would investigate the claim and realize that there is no way to prove that anyone is at fault because no injury or illness has occurred.  If you were hospitalized, then there would be a claim here but it would not be paid out because again there is no way to find fault.  Trust me, I have seen a lot of bogus claims like these that are just a waste of paper and nothing more.  Hope this helps!

    Sorry, one more thing....food claims are the worst type of claims because the majority of the time unless you choked at the restaurant and were immediately hospitalized directly from the restaurant.....it is extremely difficult to prove without examining the chewed food that their food was the culprit.  The same with food illnesses, it is extremely difficult to prove that the restaurants' food caused your illness unless you died and then they can do an autopsy on you.  I doubt you would allow them to do an autopsy on you while you were alive.

  11. The thing is - the key word is ALMOST. You didn't choke. Even if you did, you wouldn't have any grounds unless if you were allergic and you had said no anchovies.

  13. You should forgive them. They weren't the ones that choked on your food. They were just doing there jobs. Which is to feed you. Not unless you know someone there that did it on purpose for something you. I also believe that you have teeth in your mouth. Use them for something. And if it was as big as a whale don't you know how to chow.
