I almost ran a guy over (while he was corssing on red). who'se fault would it have been?

the light turned green for me, so i went forward (not knowing some guy is slowly crossing in the intersection on red (his light). the reason i didn't see him is cause there was a big truck that was blocking my view.

ps, he saw me that i almost hit him, he did raise his hand and appolagised for his stupidity of walking on red and having me stop when i had the green light.

i slammed on my brakes like an inch from his feet. if i would have hit and killed or injured him, who'se fault would it have been?

mine for not seeing him cause the big truck and cause when i see green i automaticall step on the gas to cross and don't think idiots are still crossing the street

or his for walking on a red light.

  5. even if the pedestrian was in the wrong they have the right of way in court.

    if this was to happen you would have to involve the police and get as mayn whitnesses as possible to prove that the crossing person was wrong

    after that it all rests on the officer who responds and if necessary on the judge (if pedestrian sues)

  7. according to the law books a pedestrian has the right of way at all times no matter what!!!.the light might have been red for you but it might have been green for him when he started to cross the road,and while crossing his light changed and he was caught in the cross walk,when your light changed for you to go.always give the right of way don't demand it,be a defensive driver not an offensive one,

I hit a girl...it was red light for me so I was gradually pressing my brakes...but she wasn't walking on the pedestrian crossing..she was crossing like 10 feet before that..and I didn't see her because of the other cars...She had to go to the hospital emergency..The police said it was her fault....just because she wasn't crossing on the pedestrian crossing...but as of what I know...as long as their crossing right..they could be crossing on green and turns red while crossing..u have to wait until they have crossed.....Police would take a judgmental call on that..since u weren't able to see him because of the big truck..and green for u...so It's judgmental..

  13. pedestrians do not have right of way when there is a controlled crosswalk, if they are crossing when it says do not cross, theyre jaywalking and if you  hit them, you can sue for damage to your car

Sorry, it's always the driver of the car who would be at fault.  It might not seem fair, but pedestrians can do whatever they want, willy nilly, short of running out directly towards a moving vehicle, and it'd be the driver's fault.  It's why so many insurance scammers will intentionally get themselves hit while crossing the street, intentionally, when there is oncoming traffic.  The law requires that a driver be able to see completely everything around him before proceeding.  If a driver sees that there are pedestrians around they should predict that the stupid pedestrian will immediately without warning enter the road.  Once a walking idiot steps off the sidewalk a driver is to stop.  Of course, it's against the law to block the flow of traffic, so go figure.

  20. depends on where you are from. in Texas you can run him over. in Oregon the pedestrian could be playing golf on the freeway and you cant hit him

  21. As one who designs crosswalks, traffic signals, roads and highways, I see this every day.

    if a pedestrian starts into the crosswalk on either a yellow or a red, HE DOES NOT HAVE THE RIGHT OF WAY.  

    This does not relieve you of avoiding a collision if you can.

    Every year people are struck, injured and killed thinking they as pedestrians have the right of way whenever they enter the crosswalk or even the street.  This simply is not true.

    that being said, dealing with traffic is all about human behavior and psychology.

    In our own office, (full of traffic engineers) one or more of us has been struck crossing the street at the light.  sometimes by being stupid pedestrians and sometimes by stupid drivers.

    You cannot be held responsible for someone elses stupidity or suicidal behavior.

    But this particular  "idiot" was  crossing the street on light.

    If the were light, it must be pedestrian crossing lines too.

    You forget that the streets are the places were people allow others to use vehicles.

    What would be if instead of this idiot would be someone on wheelchair?

    The green light doesn't means you should step on the gas, right away,

    and "having me stop when I had the green light"

    means you practically was moving.

    No mater wat you thing about me, you should change the way of driving and thinking.

    Tomorrow may be you could cross the light and some one in the car will think, what's idiot?
