it could but most likely will not.

The speed limit is the high limit on speed.  Anything over the posted speed limit is considered speeding and could warrant a ticket.  

Probably 99.9% of officers will not bother if you are only traveling 5 mph over.  There could be that much in speedometer variances at higher speeds.

I would say you are safe. Most states will not stop you for 5 mph over. They might in a school zone or in a residential area. Anywhere else you should be safe.

Any amount over the speed limit is considered speeding.

The DMV says even if you drive one mile more you can get a ticket.
