Question:

I am American citizen, he's not!

My bf is currently in India. He is currently studying engineering and plans to come to America with a work permit? My question is that when he comes here on working basis, can I still marry him in court? And if we do get married, can he still work in the US? I am an American citizen. Will marrying me make him an American citizen too?

  1. Yes, it will make him an American citizen.  People actually pay other people to get married to make them citizens.

  3. Marrying him will NOT make him a citizen. Marrying a US citizen never, ever makes a foreigner a US citizen.

    However, he will be able to apply for a green card. That will not affect his authorization to work in the US in any way.

    However, I understand your boyfriend does not have a work permit/visa yet. If that is true, then you might as well apply for him to come to the US as your fiance. He will then be allowed to marry you and work.

    Doing so enables him to marry you, to work, and spares him the huge trouble of getting a work permit.

    If he's already guaranteed a work permit, then you can still marry, although the process is a little different.

  4. Your boyfriend is studying, but does he have a job offer? Or this is simply a plan you'd like to undertake? In any case, if he receives a job offer and comes here on a work visa (likely H1B or perhaps L1), you are indeed entitled to marry him. You also could go to India and marry him there. Whereupon you could visit the American Consulate (or Embassy) nearest to his state of residency and file a petition for an immigrant visa. Or you could attempt to file a fiancee visa here if you are engaged. Bear in mind, options 2 and 3 are more time-consuming and expensive. As other readers have noted, marrying him will not make him a US citizen.  

  5. Yes, you can marry him when he gets here. After that you can apply to Adjust his Status, if he gets approved he'll be issued a green card good for two years. He should apply for Removal of Conditions 90 days before his green card expires. He will then be issued a 10-year green card. However, he has the option to apply to be Naturalized Citizen if he has been a Permanent Resident or green card holder for three years and have been married and living with you in a valid marital union for all three years AND he meet the other criteria (Residence and Physical Presence, Good Moral Character, Language etc).
