i am 16 years old and want to get immancipated but dont really know how to go about it. i need to know what to do and how to do it. do you need parental permission to do so?

  1. I would suggest seeing a lawer first and asking them what steps one should take. I know that it can be a long process and can be expensive. I would suggest figuring out another way to leave your parents or guardian other than immmancipation because it is difficult to acuire unless there is a very good reason: physical abuse and if the guardian is doing something that is not for your benefit, like spending thousand of your dollars on something for themselves.

I think this varies by state.  In California, I believe your parents can give permission for emancipation.  If they refuse to do this, the alternative is going through the court system.  In order to do this without your parent's permission you will need to prove that you are capable of taking care of yourself.  They will probably want to see that you are continuing your education or already graduated highschool via diploma, ged, or proficiency exam.  They will want to see that you have a job (minimum of six months most likely) and you will also probably need references such as school teachers, friends, etc.  Depending on your situation, you probably don't need a lawyer to do this.  If it is a case of abuse there are other alternatives.

  4. You have to apply to the courts for it and provide proof that you can financially support yourself and that you have a place to live.  If you are working with a place to live then they will take it more seriously.

Dear girl, stay home!!!!!!!!  Unless you are being abused (plz let me know)  Anyway I left home early, I think it was the day I turned 17.  I have been involved in drugs, drinking.........quit school, u name it I did it.  I am 42 now, and I have a 16yr old that wants to take that road as well.  You will see it's not so bad at home, you kids just think you are all grown up (so did I)  and you don't have very long before you can move out, just go with the flow, and don't be a ***** to your parents, show some respect.  I'm sure your parents love you, and you just want to be independent.  Anyway I just looked up the laws http://www.legislature.mi.gov/(S(scskgk4...  You have to prove you can take care of yourself.  That is for Michigan, just look up Emancipation in your state.  You should really know how to spell it too.. Stay home sweetie.
